๐จ โMAYโ or โSHALLโ? One Word Changes Everything ๐จ
Did you know a single word in your stateโs law can decide whether public schools must excuse students for religious classes during the school day?
๐ ๐๐ก๐ ๐๐ซ๐๐๐ค๐๐จ๐ฐ๐ง:
โ โ๐๐๐ฒโ ๐๐ญ๐๐ญ๐๐ฌ โ Law says districts may allow released time. Itโs optional. Local boards can approveโor rejectโprograms like LifeWise.
๐ Example: Kentuckyโs law (KRS 158.200) says a district may provide an opportunity for students to attend moral instruction classes during the school day.
That word ๐๐๐ means local school boards are not required to approve or coordinate with programs like LifeWise โ itโs entirely their choice.
If a district does approve a program, the law outlines:
๐Students who attend get full attendance credit as if they were in school.
๐Students who donโt attend must be placed in โnoncredit enrichmentโ or activities outside the regular curriculum (study hall, art, music, library, PE, etc.).
๐These students can be grouped with other grade levels.
Because the law starts with ๐๐๐, districts in Kentucky ๐๐จ have the option to deny requests for released-time religious instruction. However, districts that wish to deny a program must include a reason for denial in their reporting.
Effectively, Kentucky is a โ๐๐๐ฒโ state โ Bottom line: Kentuckyโs law makes released time possible, not automatic. Every district still decides for itself โ which means community input matters.

โ โ๐๐ก๐๐ฅ๐ฅโ States โ Law says districts shall allow released time if certain conditions are met. Once the boxes are checked, ๐ญ๐ก๐๐ฒ ๐ฆ๐ฎ๐ฌ๐ญ ๐ฌ๐๐ฒ ๐ฒ๐๐ฌ.
๐ Example: Ohioโs law (Ohio Revised Code ยง 3313.6022) says a school district ๐๐ก๐๐ฅ๐ฅ adopt a policy that authorizes students to be excused for released-time religious instruction if certain conditions are met.
๐ Example: Tennesseeโs law says a district may adopt a policyโฆ but also says schools ๐๐ก๐๐ฅ๐ฅ excuse students upon parental requestโeven without a policy. That means districts do not have the option to deny releasedโtime requests if all statutory requirements are satisfied. Effectively making Tennessee a โ๐๐ก๐๐ฅ๐ฅโ state.
