🚨 Public-Education Alert: Arkansas Voucher System Under Fire 🚨
Today the Little Rock School District (LRSD) has asked a federal court for permission to intervene in a lawsuit challenging the constitutionality of the state’s new voucher program, the Educational Freedom Account (EFA) program.
Why it matters:
• LRSD argues that the voucher program diverts taxpayer dollars away from public schools to fund private, mostly religious schools — “to the detriment of LRSD and other Arkansas public school districts.”
• For every student who leaves LRSD for a private or home-school option under the voucher law, LRSD says it loses resources needed to educate its remaining students.
• The program, created under the LEARNS Act of 2023, is projected to cost $326 million in 2025-26 — more than the Legislature budgeted.
• The district argues the program violates the Establishment Clause of the First Amendment (because public funds support sectarian private schools) and the Equal Protection Clause of the Fourteenth Amendment (because it discriminates against low-income families, rural students, and children with disabilities).
• LRSD emphasizes that its students generally have greater educational needs than many private schools being supported by vouchers — “an outcome which allows the state to continue to invest in a separate private school system for more affluent students will inevitably work to the detriment of the constitutionally required free public school system.”
